Terms of Service

These Terms of Service govern your use of Motionfy. Please read them carefully before using the Service.
1. Who we are
Motionfy is operated by Manuel Somoza Vázquez, a sole trader (autónomo) registered in Spain, with tax ID (NIF) 34310301M and address at Sarria, Lugo, Spain. You can contact us at info@aimotionfy.com for any question about these Terms.
2. Acceptance of these terms
By creating an account or using Motionfy (the "Service"), available at aimotionfy.com, you agree to these Terms of Service. If you don't agree, please don't use the Service.
3. What the Service does
Motionfy lets you upload photos of rooms and generates short animated videos showing furniture appearing, using artificial intelligence. The Service is provided as a paid subscription with monthly usage credits.
4. Your account
You must provide accurate information when creating an account and keep your password secure. You're responsible for all activity under your account. You must be at least 18 years old, or the legal age of majority in your country, to create an account.
5. Plans, billing and cancellation
Paid plans are billed monthly or annually through our payment processor, Stripe. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You can cancel or change your plan at any time from your account's billing portal; cancellation stops future renewals but doesn't refund the current period unless required by law. We don't store your card details — Stripe processes and stores payment information under its own terms and privacy policy.
6. Content you upload
You keep ownership of the photos you upload and the videos we generate for you. By uploading a photo, you grant us a limited licence to process it — including sending it to our AI video-generation providers — solely to produce and deliver your video and to operate the Service. You must only upload photos you have the right to use, and must not upload illegal content, content that infringes someone else's rights, or content depicting people without their consent. We may remove content or suspend accounts that breach this rule.
7. Third-party AI providers
To generate the animated videos, we send your uploaded photos to third-party AI processing providers. We choose providers that offer contractual data-protection guarantees; see our Privacy Policy for details.
8. Intellectual property
The Motionfy name, logo, website and underlying software are our property or that of our licensors and are protected by intellectual property law. Nothing in these Terms transfers any of that to you, except the right to use the Service as intended.
9. Acceptable use
You must not: use the Service for unlawful purposes; try to disrupt, reverse-engineer or overload our systems; resell or redistribute the Service without our written consent; or use it to generate content that is defamatory, deceptive, or infringes third-party rights.
10. Availability and changes
We aim to keep the Service available but don't guarantee uninterrupted access; we may perform maintenance, or modify or discontinue features, with reasonable notice when practical.
11. Limitation of liability
To the extent permitted by law, we're not liable for indirect or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under Spanish law, including liability for wilful misconduct or gross negligence, or the rights recognised to consumers under Spanish consumer-protection law.
12. Suspension and termination
We may suspend or terminate accounts that breach these Terms, including unpaid invoices or abusive use. You can stop using the Service and delete your account at any time from your account settings.
13. Data protection
Our Privacy Policy explains how we collect, use and protect your personal data, and forms part of these Terms.
14. Changes to these terms
We may update these Terms from time to time. We'll post the updated version on this page with a new "last updated" date; continued use of the Service after changes take effect means you accept them.
15. Governing law and jurisdiction
These Terms are governed by Spanish law. Any dispute will be submitted to the Spanish courts; if you're acting as a consumer, this is without prejudice to your right to bring proceedings before the courts of your own place of residence, as provided by applicable consumer-protection law.
