This Privacy Policy explains how Motionfy collects, uses and protects your personal data.
1. Data controller
The controller responsible for the personal data processed through Motionfy (aimotionfy.com) is Manuel Somoza Vázquez, sole trader (autónomo), NIF 34310301M, address at Sarria, Lugo, Spain. Contact: info@aimotionfy.com.
2. What data we collect
Account data: your name, email address and password (stored encrypted). Content data: the photos and videos you upload or generate, and metadata about your projects (room type, status, file paths). Billing data: your subscription plan, billing interval and subscription status; payment details themselves (card numbers, etc.) are collected and stored directly by Stripe, not by us. Technical data: information generated automatically when you use the Service, such as authentication session identifiers.
3. Purposes and legal basis
We use this data to: create and manage your account and provide the Service (performance of a contract); process payments and manage your subscription (performance of a contract); generate the videos you request, including sending your photos to our AI providers (performance of a contract); respond to your support requests (legitimate interest and, where applicable, your consent); and comply with legal obligations, such as tax and accounting rules (legal obligation).
4. Who we share your data with
We share personal data only with the service providers (processors) that help us run Motionfy, under contracts that require them to protect your data and use it only for the agreed purposes: Supabase (database, authentication and file storage); Stripe (payment processing and subscription billing); Kling AI and OpenAI (processing of the photos you upload, to generate the key frames and animated videos). We don't sell your personal data to anyone.
5. International transfers
Some of these providers may process data outside the European Economic Area. When that happens, we rely on the safeguards recognised by the GDPR, such as the European Commission's Standard Contractual Clauses, as offered by each provider.
6. How long we keep your data
We keep your account and project data for as long as your account is active. If you delete your account, we delete or anonymise your personal data within a reasonable period, except where we must keep certain billing records to comply with tax and accounting obligations, generally for the periods required by Spanish law.
7. Your rights
You can ask us to access, rectify, delete, or port your personal data, and to restrict or object to its processing, by writing to info@aimotionfy.com. You also have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, www.aepd.es) if you believe your rights have not been respected.
8. Security
We apply reasonable technical and organisational measures to protect your data, including encrypted connections and access controls, and rely on our providers' own security measures (Supabase, Stripe).
9. Cookies
We only use strictly necessary cookies — to keep you signed in and to let Stripe process payments securely during checkout. We don't use analytics or advertising cookies, so no cookie-consent banner is required for these.
10. Minors
The Service is intended for professional use by real estate agencies and is not directed at people under 18. We don't knowingly collect data from minors.
11. Changes to this policy
We may update this Privacy Policy from time to time. We'll post the updated version here with a new "last updated" date.
